By creating an account, accessing, or using the noIM₃ platform at noim3.com ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all users including visitors, registered users, and subscribers. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

2. Description of Service

noIM₃ is a professional engineering platform providing browser-based tools, calculators, and design aids for communications and electrical engineers. The Platform includes RF planning tools, HF propagation analysis, leaky feeder design, electrical system calculators, ACMA spectrum tools, and related engineering utilities.

We reserve the right to modify, suspend, or discontinue any feature or the Platform at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

3. User Accounts

To access most features of the Platform you must create an account. You agree to:

4. Subscriptions and Payment

Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually as selected). Payment is processed by our third-party payment provider. By subscribing, you authorise recurring charges to your nominated payment method.

Cancellation and refunds

You may cancel your subscription at any time from your Account page. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

5. Acceptable Use

You agree not to use the Platform to:

6. Intellectual Property

The Platform, including its content, features, design, software, and underlying engineering models, is owned by noIM₃ and protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for your own professional purposes.

You retain ownership of any data or inputs you provide to the Platform. You grant us a limited licence to process that data solely for the purpose of providing the service to you.

7. Disclaimer of Warranties

The Platform and its calculation outputs are provided "as is" and "as available" without warranties of any kind, express or implied. While we take significant care to implement accurate engineering models based on international standards, we do not warrant that:

• Calculation results are error-free, complete, or suitable for any specific purpose
• The Platform will be uninterrupted, secure, or available at all times
• Results will meet the requirements of any regulatory authority

Engineering outputs from the Platform must be verified by a suitably qualified engineer before being relied upon for regulatory submissions, safety-critical decisions, or commercial deployments.

8. Limitation of Liability

To the maximum extent permitted by applicable law, noIM₃ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.
